What is a regulated credit agreement with Zilch?

You enter into a regulated credit agreement with Zilch when you use your Zilch card to make a credit transaction and pay a fee – or when you use Zilch Snooze to delay a payment.

Your Financial Ombudsman Service rights

A regulated credit agreement gives you the right to take your complaint to the Financial Ombudsman Service (FOS). This means if you have a complaint about your regulated credit agreement and you’re unhappy with Zilch’s response, you have the right to refer your complaint to the FOS, free of charge – but you must do so within six months of the date of the final response.

Section 75

Section 75 of the Consumer Credit Act gives you additional protection on credit card purchases from £100–£30,000. If you have a claim for breach of contract or misrepresentation against the supplier of the goods or services, section 75 gives you the same claim against Zilch.

Your Financial Ombudsman Service rights

You do not have FOS rights with unregulated credit agreements, which means if you have a complaint about your credit agreement and you’re unhappy with Zilch’s response, you do not have the right to refer your complaint to the FOS.

Section 75

With unregulated credit agreements, you have no rights under section 75 of the Consumer Credit Act. So, if you have an issue with the goods or services you’ve purchased using credit provided under this unregulated agreement, you must contact the retailer directly to resolve any dispute.
